Michael Disher was reading a "patient's chart in the Otolaryngology Clinic at the University of Michigan Medical Center on June 25 when he heard gunshots. i Disher raced toward the sounds and -looked in the window of an examining room where he saw Chester Posby in a chair and Dr. John Kemink, a nationally renowned ear specialist, lying on the floor bleeding. i "It was the beginning of a nightmare," Disher testified Wednesday in 15th District Court in Ann Arbor. Posby, 69, of Clinton Township, was bound over for trial on open murder charges by Judge Timothy Cdnnors, who earlier Wednesday ruled Pqsby was competent to stand trial.

Disher testified that he summoned help, then turned around to find Posby in! the hallway with a green towel covering his hand. Disher guided Pqsby to another examining room. "When I asked Mr. Posby why, he told me, 'He betrayed me. He was a gojod doctor but he betrayed me.

Beloved hus sat behind Posby. Her eyes filled with tears frequently. Posby fidgeted during the preliminary exam and the three-hour competency hearing that preceded it. He asked for breaks to eat fruit that he said would "balance the fluid in my inner ear." Posby asked the judge to remove Ruth Vernet as his counsel and assign him a new attorney. Posby said Ver-net's attempt to have him declared incompetent to stand trial, "makes my case look flimsy." Connors denied the request and referred him to the Washtenaw County Public Defender's Office, which appointed Vernet.

In asking that her client be declared incompetent, Vernet argued that Posby's belief that Kemink was involved in a conspiracy to murder him during brain surgery interfered with his ability to assist in his defense. Posby was found competent but mentally ill by Dr. Gail Farley, a psychologist, and psychiatrist Dr. Stephen Cook in an examination at the state Center for Forensic Psychiatry near Ypsilanti. But Dr.
